These Terms of Use ("Terms") are a legal agreement between you and Praveen Baid (individual) ("SmartHold", "we", "us"), governing your use of the SmartHold website and Android app. By creating an account or using SmartHold in any way, you agree to these Terms. If you don't agree, please don't use SmartHold.
SmartHold screens stocks against public fundamentals, ranks them by momentum, and applies a fixed, mechanical rule to flip a holding into gold when its own price trend breaks. This is a transparent, rules-based educational and research tool — it is not personalized investment advice, a recommendation to buy or sell any security, or a solicitation of any kind. See our Disclosure page for the full explanation of how the method works, its data sources, and its limits — including that SmartHold is not a SEBI-registered Investment Adviser or Research Analyst.
Nothing in SmartHold — including any backtest result, win rate, CAGR figure, or historical statistic shown in the app or on this website — is a guarantee, promise, or prediction of future performance. Past performance, real or backtested, is never a reliable indicator of future results. All securities investments carry risk, including the risk of losing your entire principal.
Every buy, sell, or hold decision you make — whether or not it follows a signal shown in SmartHold — is entirely your own, made at your own discretion and risk. SmartHold never places trades. Any buy/sell entries you log are your own personal record-keeping. You are solely responsible for your own investment decisions, for complying with any tax or regulatory obligations that follow from them, and for doing your own research (or consulting a SEBI-registered professional) before acting on anything shown in the app.
You agree not to: use SmartHold for any unlawful purpose; attempt to gain unauthorized access to any part of the service, another user's account, or our systems; scrape, reverse-engineer, or systematically extract data from the app beyond your own normal personal use; interfere with or disrupt the service; or misrepresent SmartHold's outputs as investment advice to a third party.
SmartHold is currently free during its beta. If we ever introduce a paid plan, we will give existing users at least 30 days' notice, and nothing will be charged without your explicit consent.
The SmartHold name, the app's design, its underlying strategy logic, and its content are owned by us (or our licensors) and protected by applicable intellectual property law. These Terms don't grant you any right to use our branding, copy our methodology, or redistribute the app's outputs commercially.
We may suspend or terminate your account at any time, with or without notice, including (without limitation) for a breach of these Terms, suspected misuse, or at our own discretion. You may stop using SmartHold, and request deletion of your account and data, at any time — see our Privacy Policy for how.
SmartHold is provided "as is" and "as available," without warranty of any kind, express or implied. We don't warrant that the service will be uninterrupted, error-free, or that any data (prices, fundamentals, signals) will always be accurate, complete, or timely — see the Disclosure page for known data limitations (e.g. price delays, occasional data-provider gaps).
To the maximum extent permitted by applicable law, SmartHold and its operator(s) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or investment value, arising from your use of (or inability to use) the service — including losses from any trading or investment decision you make, whether or not based on anything shown in the app.
You agree to indemnify and hold us harmless from any claim, loss, or demand (including reasonable legal fees) arising from your use of SmartHold, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of SmartHold will be subject to the exclusive jurisdiction of the courts at Surat, Gujarat.
We may update these Terms from time to time. If we make a material change, we'll update the date at the top of this page and make a reasonable effort to let existing users know. Continuing to use SmartHold after a change takes effect means you accept the updated Terms.
